Lien Claims

North Carolina recognizes a lien framework in construction which provides a mechanism for contractors, subcontractors or suppliers to seek payment for work performed or material supplied to a particular parcel of land. How long do I have to file a lien? A valid lien in construction cases must be filed within 120 days from the last date of work. An action to enforce the lien must be filed within 180 days from the last date of work. This does not mean these are the time frames in which you should file (you should not wait that late), however these are the absolute deadlines to make your claims. Late filings will not stand.
