The Law

Automobile Accidents and trucking cases are governed in general by the law of negligence. Motor Vehicle Negligence, simply put is the failure to observe the standard of a reasonable person while operating a motor vehicle. In other words, the failure to use reasonable care when driving. This can take many forms:

  • Driving too fast.
  • Driving too slowly.
  • Failure to keep a proper lookout while driving.
  • Following too close.
  • Running a red light.
  • Running a stop sign.
  • Changing lanes without looking.
  • Failure to maintain safety equipment causing an accident.
  • Unsafe movement.
  • Pulling out into traffic when such a maneuver could not be made safely.

The possibilities are endless and you must be able to demonstrate damages (injuries) which were proximately caused by the accident.

What To Do When You Are Injured in an Accident

Outside of your immediate medical care, the most important thing to remember is that from the moment an insurance company learns about your accident, they are already working hard to minimize any compensation you may get as a result of your injuries, regardless of what is fair. In many cases, they hire lawyers, accident reconstruct experts, adjusters, and others to help them defend against people who have been injured in accidents through no fault of their own. Never forget, an insurance company is in business to make money, not to give fair settlements. You need someone on your side who knows how to deal with the insurance company; an experienced attorney who will listen to you and who will stand up to the insurance company.

That`s where we come in. At Doyle & Doyle, PA, we fight hard for our clients to make sure they get the settlement they deserve. And if the insurance company will not settle, we will take them to trial. We make sure they know that.

What To Do When an Accident Happens

  1. Seek immediate medical attention for all involved. Any delay can endanger your health, and will often prompt an insurance company to later claim that you were not really injured in the accident. If you have uncontrolled pain anywhere, the safest thing to do is call an ambulance and accept the trip to the hospital for tests and follow up. Do not downplay your injuries to medical providers or witnesses. Resist the urge to look tough and seek the care you need.
  2. If your condition allows it, look for witnesses at the scene. If you are able, report all witnesses to the investigating officer. In the event you speak to any witnesses, try very hard to get their contact information. You cannot count on law enforcement to do this for you. It would be best to call a friend or family member to help if possible.
  3. Pictures, pictures, pictures. The old saying that a picture is worth a thousand words is so true. Take multiple pictures of your injuries. Document the condition of your car with multiple pictures. We recommend the use of video recorders which we have available to assist Clients with documenting rehabilitation and surgery as well.
  4. Don`t talk to the insurance company until you have spoken to an attorney. It is imperative that you know your rights. Insurance companies often call or visit injured victims, tape recorder in hand, and cross-examine them about what happened in the accident and the extent of their injuries. These individuals are trained in questioning injured victims. Don`t face them alone.
