Valuing Assets

In an equitable distribution case, a judge, after identifying the property as marital, must value that property as of the date of separation. A judge must be provided credible evidence of the value during a trial on equitable distribution. Parties may agree on a value, or evidence must be presented as to value sufficient to convince a judge that that is the fair market value of the asset as of the date of separation.
