Alimony

Alimony is money paid by a “supporting spouse” to a “dependent spouse” in North Carolina. The law of alimony is complex and evolving. Prior to October 1995, “marital fault” was an essential element in any claim for alimony. The Legislature revised the law in October of 1995 to eliminate fault as a requirement for an alimony claim and established “marital misconduct as only one factor among many to consider. The result of this change was to make alimony much more of a financial issue as opposed to a “who did what to whom” issue. This is not to say that the behavior of a spouse is irrelevant in the analysis however. Pre-separation adultery still proves a valuable defense to alimony claims. Other “bad acting” so to speak can have negative consequences in an alimony case. The ability to earn, the lifestyle of the parties prior to separation, along with other financial factors also plays a significant role in alimony cases. It is also important to keep in mind that alimony carries with it serious tax considerations which should be factored into any trial or settlement of the issue.
